1. Agreement to Terms

By accessing or using the Tuwaye AI mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Tuwaye AI provides AI-powered speech therapy and communication improvement tools, including:

  • Speech recognition routed for Ugandan English, Luganda and Kiswahili
  • Speech analysis and pronunciation scoring
  • Guided therapy exercise modules
  • Progress tracking and reporting
  • Text-to-speech synthesis (Spark-TTS)

Important: Tuwaye AI is a supplementary tool and does not replace professional medical advice, diagnosis, or treatment from licensed speech therapists or healthcare providers.

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use Tuwaye AI. Users under 18 require parental or guardian consent.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Subscription Plans and Payments

4.1 Free Tier

The Freemium plan provides limited access at no cost. We reserve the right to modify or discontinue the free tier at any time.

4.2 Paid Subscriptions

  • Individual Pro: Current price and billing interval are shown before payment
  • Organization Plans: Custom pricing for bulk licenses

4.3 Billing and Refunds

Subscriptions auto-renew unless canceled before the renewal date. Refunds are provided on a case-by-case basis within 7 days of initial purchase.

4.4 Payment Methods

We accept MTN Mobile Money, Airtel Money, and other local payment methods. Payment processing is handled by secure third-party providers.

5. User Conduct

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Upload harmful, offensive, or inappropriate content
  • Attempt to reverse-engineer, hack, or compromise the Service
  • Share your account credentials with others
  • Use automated tools to access the Service (bots, scrapers)
  • Misuse or abuse therapist assignment features

Violation of these terms may result in account suspension or termination.

6. Intellectual Property

6.1 Our Rights

All content, features, and functionality of Tuwaye AI (including AI models, designs, logos, and software) are owned by us and protected by copyright, trademark, and intellectual property laws.

6.2 Your Content

You retain ownership of your voice recordings and personal data. By using the Service, you grant us a limited license to process your voice data for the purpose of providing speech analysis and therapy services.

7. Data Privacy

Your use of the Service is also governed by our Privacy Policy. We are committed to protecting your personal information and voice data through encryption and secure storage practices.

8. Medical Disclaimer

IMPORTANT: Tuwaye AI is NOT a medical device and does not provide medical advice, diagnosis, or treatment. The AI analysis and scores are for informational and practice purposes only. Always consult with a licensed speech-language pathologist or healthcare provider for medical concerns.

9. Limitation of Liability

To the maximum extent permitted by law, Tuwaye AI and its affiliates shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Service interruptions or technical errors
  • Inaccuracies in AI speech analysis

Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Service Availability

We strive for 99% uptime but do not guarantee uninterrupted service. We may suspend the Service for:

  • Scheduled maintenance
  • Emergency repairs
  • Security updates
  • Legal or regulatory compliance

11. Beta Features

As we are currently in Public Beta, some features may be:

  • Incomplete or experimental
  • Changed or removed without notice
  • Subject to bugs or performance issues

We appreciate your feedback to help us improve the Service.

12. Account Termination

12.1 By You

You may cancel your subscription or delete your account at any time through the app settings.

12.2 By Us

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse or harass other users or staff

13. Organization and NGO Accounts

For bulk organization licenses:

  • The organization administrator is responsible for seat allocation and management
  • User data is accessible to assigned therapists and administrators
  • Licenses are non-transferable between organizations
  • Custom contracts may apply for enterprise arrangements

14. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via:

  • Email notification
  • In-app announcement
  • Website banner

Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Uganda. Any disputes shall be resolved in the courts of Kampala, Uganda.

16. Dispute Resolution

Before filing a lawsuit, we encourage you to contact us to resolve disputes informally. We aim to resolve issues within 30 days.

17. Third-Party Services

The Service may integrate with third-party services (e.g., payment processors, cloud storage). We are not responsible for their terms or privacy practices.

18. Indemnification

You agree to indemnify and hold Tuwaye AI harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.
